Court Clears Homicide But Finds Nurse’s Action Unlawful and Professionally Negligent.”
The Coroner’s Court in Ikorodu, Lagos State, has called for the criminal prosecution of auxiliary nurse Feyisayo Ogedengbe following the controversial passing of Nigerian artist, Ilerioluwa Aloba, popularly known as Mohbad.
In its verdict delivered on Friday, Magistrate C.A. Shotobi determined that the nurse displayed gross negligence by administering an injection to the deceased singer without a prescription from a certified medical doctor.
Although the court ruled out foul play or homicide, it stated that Ogedengbe’s actions were both “unlawful and professionally negligent.”
”In pursuant to section 29 of the coroner laws of Lagos State, this court recommends that the prosecution of the unlicensed medical personnel by the office of the Director of Public Prosecution should commence appropriate prosecution against Felicia Ogedengbe for unlawful medical practice and gross negligence,” the magistrate said.
Separately, on Wednesday, Joseph Aloba, the father of the late singer Ilerioluwa Aloba, also known as Mohbad, filed a notice of appeal challenging a ruling by the Lagos State High Court which declined to invalidate legal advice from the Director of Public Prosecutions (DPP) clearing Naira Marley and Sam Larry of any role in his son’s death.
Represented by his counsel, Wahab Shittu (SAN), Aloba submitted the appeal on Monday, July 7, 2025, at the Court of Appeal in Lagos.
He argued that the lower court made a legal error by ruling that the Attorney-General’s powers under Section 211(1) of the 1999 Constitution are “settled and unassailable,” and that decisions on prosecution are final and cannot be legally contested, except for issues of public or political accountability.
